Welcome to the FriCARE website and support center. These Terms & Conditions ("Terms") govern your access to and use of the FriCARE website, support pages, warranty registration forms, downloadable materials, videos, FAQs, contact forms, campaigns, and related services (collectively, the "Site").

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. About the Site

The Site is provided by FriCARE to offer product information, support resources, warranty registration, customer service contact options, and related content.

2. Eligibility

You must be at least 13 years old to use the Site. If you are under the age of majority in your jurisdiction but at least 13, you may use the Site only with the involvement of a parent or legal guardian.

The Site is not directed to children under 13.

3. Informational Use Only / No Medical Advice

The Site, including manuals, support videos, FAQs, and other content, is provided for general informational and product-support purposes only. It is not medical advice, diagnosis, treatment, or professional healthcare instruction.

Always follow the instructions, labeling, and warnings provided with your product. If you have questions about a medical condition, treatment, or the meaning of any health-related result, consult a qualified healthcare professional.

4. Product Support and Warranty Help

The Site is intended to help users find product support quickly and to contact us by email or form if additional help is needed.

Support information on the Site is general in nature and may not address every situation. If your issue is not resolved through the Site, contact us directly using the support options provided.

Warranty registration helps us keep product and contact information on file, but registering a product does not automatically create coverage beyond any applicable written warranty, law, or specific replacement policy that applies to your purchase.

5. Accuracy of Information You Submit

You agree that information you submit through the Site will be truthful, accurate, current, and complete to the best of your knowledge.

This includes, without limitation:

  • contact information;
  • product details;
  • order information;
  • support descriptions;
  • warranty registration details;
  • uploaded photos, videos, or documents.

We may rely on the information you submit to respond to support requests, review replacement issues, and administer Site functions.

6. User Content and Submissions

If you send us or upload any content, including messages, photos, videos, reviews, testimonials, or other materials ("User Content"):

  • you represent that you own or control the rights necessary to submit it;
  • you represent that your submission does not infringe another person's rights;
  • you agree NOT to submit unlawful, deceptive, abusive, defamatory, harassing, obscene, or harmful content;
  • you agree NOT to upload malware, viruses, or harmful code;
  • you agree NOT to submit highly sensitive information unless specifically requested for a legitimate support purpose.

A. Support-related submissions

When you submit User Content for support, warranty review, or troubleshooting, you give us a non-exclusive, worldwide, royalty-free license to use, reproduce, store, review, modify for technical purposes, and otherwise process that User Content as necessary to evaluate and respond to your request, improve our support operations, maintain records, prevent fraud, and enforce our rights.

B. Promotional or public-use submissions

If you separately agree to let us use your User Content in advertising, social media, email, product pages, or other public-facing materials, you grant us the additional non-exclusive, worldwide, royalty-free, transferable, sublicensable right to use, reproduce, adapt, publish, display, distribute, and create derivative works from that User Content for marketing and business purposes, subject to any separate consent, release, or campaign rules you accept.

We are not required to publish, use, or retain any User Content.

7. Promotional Activities, Contests, and Campaigns

From time to time, we may offer promotions, contests, sweepstakes, surveys, UGC campaigns, or social media activities. These may be governed by separate official rules, eligibility requirements, disclosure requirements, or consent terms.

If separate rules apply, those rules will control to the extent of any conflict with these Terms.

When you contact us or use the Site, you agree that we may communicate with you electronically regarding your support request, warranty registration, or related service matters.

If you separately opt in to marketing communications, you agree that we may send promotional emails in accordance with your preferences and applicable law. You can unsubscribe from marketing emails at any time using the unsubscribe link or by contacting us.

9. Intellectual Property

The Site and its contents, including text, graphics, design, logos, videos, downloads, software, and other materials, are owned by or licensed to FriCARE and are protected by applicable intellectual property laws.

Except as expressly permitted, you may not copy, reproduce, distribute, modify, publish, display, perform, create derivative works from, sell, license, reverse engineer, or exploit any portion of the Site without our prior written permission.

You may print or download materials from the Site only for your own personal, non-commercial use in connection with your legitimate product support or informational needs.

10. Acceptable Use

You agree NOT to:

  • use the Site in violation of law;
  • misuse support forms or submit false claims;
  • impersonate another person or misrepresent your affiliation;
  • attempt to access restricted areas of the Site without authorization;
  • interfere with Site performance, security, or availability;
  • scrape, crawl, or harvest Site content or user information without permission;
  • submit harmful code or engage in abusive, threatening, or fraudulent behavior;

13. Disclaimer of Warranties

To the fullest extent permitted by law, the Site and all Site content are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, or availability.

Nothing in these Terms excludes any non-waivable rights you may have under applicable consumer protection law.

14. Limitation of Liability

To the fullest extent permitted by law, FriCARE and its affiliates, officers, directors, employees, agents, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity arising out of or related to your use of the Site, even if advised of the possibility of such damages.

To the fullest extent permitted by law, FriCARE's total liability for any claim arising out of or relating to the Site will not exceed the greater of:

  • (a) the amount you paid, if any, to use the Site; or
  • (b) USD $100.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

15. Indemnification

You agree to defend, indemnify, and hold harmless FriCARE and its affiliates, officers, directors, employees, agents, licensors, and service providers from and against claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • your breach of these Terms;
  • your misuse of the Site;
  • your User Content;
  • your violation of law or another party's rights.

16. Suspension or Termination

We may suspend, restrict, or terminate your access to the Site at any time, with or without notice, if we believe you violated these Terms, created risk, or engaged in misuse, fraud, abuse, or unlawful conduct.

17. Changes to the Site or Terms

We may update the Site or these Terms from time to time. When we do, we will revise the "Last Updated" date above. Your continued use of the Site after changes become effective means you accept the updated Terms.

18. Governing Law

These Terms are governed by and construed in accordance with the laws of the People's Republic of China, without regard to its conflict-of-laws principles.

Any dispute, controversy, or claim arising out of or relating to these Terms or the Site shall be submitted to the courts with competent jurisdiction in the place where FriCARE Medical Co., Ltd. is domiciled, and you consent to the jurisdiction and venue of such courts, except where applicable consumer protection law provides otherwise.

19. Severability

If any provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy and any additional posted rules or policies that apply to specific features, constitute the entire agreement between you and FriCARE regarding the Site.
